TSC stripped of licensing powers

Anxiety has gripped the Teachers Service Commission over the exclusion of teacher licensing from its mandate in the revised TSC Draft Bill 2011.

Instead, the Kenya Law Reform Commission, Transparency International, and the TSC legal team that polished the document proposed teachers only produce a certificate of registration to teach in local institutions.

Sources at the teacher employer told The Standard On Saturday that the omission may see the commission lose powers to check and maintain the quality of teaching standards to other institutions if the new Draft Bill becomes law.

But Kenya National Union of Teachers (Knut) and the Kenya Union of Post-Primary Education Teachers (Kuppet) maintained on Friday that only an independent body should license teachers.

The position of the unions may spark off rage over teacher quality and standards assurance as the debate on the Bill takes root next week.

The commission asked the public and sector stakeholders to submit views for consideration, next week.

The unions also faulted lack of an express clause to indicate their representations in the crucial salary negotiations, discipline, vetting committees, and future boards to be set up under the Act.

Knut Secretary General Okuta Osiany said the commission should only register teachers and leave licensing to neutral bodies for the purposes of maintaining quality and keeping quacks out of the profession. Kuppet Secretary General Akelo Misore captures the same sentiments in a raft of recommendations to the commission.

In their proposal, Kuppet wants the licensing included in the Bill, but the mandate left to an independent board. "The board should be formatted in line with other professional bodies such as the Law Society of Kenya, and the Dentists Board or architecture and engineers board," read the proposal.

The union said: "The employer cannot be allowed to license. Some teachers would be denied licenses even on petty disciplinary issues."

The union said, "The board should comprise teachers as professionals, the unions, and associations. The teachers must have requisite competencies, which would be spelt out."

Education Secretary George Godia said last week teacher licensing would check teaching standards once adopted. Sources familiar with the details at the commission on Friday said the vacuum created by the experts may give Ministry of Education a chance to conduct licensing, a move that would effectively put it at the helm of policing teaching standards.
